The Ohio Court Process after a DUI/OVI arrest
Once you've been arrested for an OVI, you begin the journey through the court system. If you are arrested and taken into custody, then you may be taken to the police station and asked to blow on a breathalyzer. At this time, you can choose to refuse. Before you take any tests, you can consult with an attorney to know what your rights are. If it is determined that you will be arrested then you may be put in jail and may have to post bail to get be released. The amount of the bail varies from jurisdiction to jurisdiction. However, you may also be released without posting a bond. Finally, there are instances that the police do not take you to jail but instead release you to a friend or family member.
The next step in the DUI court process is the arraignment or the initial appearance. This is a hearing before a Judge or a Magistrate, again depending on the jurisdiction. It is at this hearing that a plea of "guilty" or "not guilty" is entered. Further, this may also be an opportunity for bond to be reconsidered or even to be set.
