Ohio DUI/OVI laws are always changing. With each change, the penalties become more severe. Further, the ability of police to investigate and to charge you with an OVI becomes easier. Finally, it is clear that OVI charges in Ohio are very serious. The law in Ohio provides heavy penalties if you're convicted; especially if you've been convicted multiple times.

Depending on whether you're facing an OVI for the first time or if you've had multiple arrests or convictions, penalties generally include incarceration, fines, court costs and a license suspension. In Ohio, there are two specific charges that police will use to charge you with an OVI:

Ohio Revised Code Section 4511.19(A)(1)(a): Driving under the influence of alcohol or drugs.

Ohio Revised Code Section 4511.19(A)(1)(d): driving with a blood alcohol concentration (BAC) of .08% or higher.

An Ohio driver will be charged with one of these two offenses usually after a traffic stop and after the police suspect that you are driving under the influence of drugs or alcohol. Once you're pulled over the police may have you exit your vehicle and perform certain field sobriety tests administered by the police. If taken into custody after you perform these tests then you will be asked to take a test to determine the level of alcohol in your breath, blood or urine. Normally, the police will request you to take a breathalyzer, to test the alcohol level on your breath. If your test, which measures blood alcohol concentration (BAC), registers at .08% or above, then you will be charged with OVI under Ohio Revised Code Section 4511.19(A)(1)(d). If you refuse the BAC test, or any request to test your blood or urine, then your license will be automatically suspended for one year under Ohio's Administrative Code. This is because your use of a driver's license includes the implied consent to be tested for alcohol.

If you refuse to take a breath, blood or urine test, then you may still be charged with Ohio Revised Code Section 4511.19(A)(1)(a), which is an OVI charge based upon the observations of you by the arresting officer. Those observations usually include your driving, your performance on the FST's and any dialogue you might have had with the police officer.
